The information, findings, photographs and reports produced by Eagle Eye Assessments (collectively the "Report") are the intellectual property of Eagle Eye Assessments ("We", "Us" or "Our"). Scope of Assessments
Assessments and surveys are carried out on a visual, non-intrusive basis unless expressly agreed otherwise in writing. Findings reflect the condition of the subject as observed at the date and time of inspection only. Latent or concealed defects that could not reasonably have been detected during the inspection may not be recorded in the Report.
Accuracy of Data
We take every reasonable step to ensure that the data, measurements and opinions contained in a Report are accurate at the time of inspection. However, conditions can change after an inspection, and a Report should not be relied upon as a guarantee, warranty or prediction of future condition, value, performance, safety or compliance of the subject.
Restrictions on Use
- The Report is for the exclusive use of the authorized recipient (the "Customer") who commissioned or purchased it from Us.
- The Customer may not reproduce, distribute, modify, translate, or create derivative works of the Report without our prior written consent.
- The Customer may not share the Report with any third party without our prior written consent, except where disclosure is required by law.
Confidentiality
The information contained in a Report may be confidential. The Customer agrees to hold such confidential information in trust and to use it only for the purposes for which it was provided.
Third-Party Reliance
Unless We have agreed in writing that a named third party may rely on a Report, We accept no responsibility or liability to any third party who obtains, reads or acts upon the Report. Any such reliance is entirely at the third party's own risk.
Disclaimer of Warranties
The Report is provided "as is" and without warranties of any kind, express or implied. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, We shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with the use of, or reliance upon, the Report. Our total liability in relation to any Report shall be limited to the fees paid by the Customer for that Report.
Governing Law
This Disclaimer and any Report are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with a Report shall be subject to the exclusive jurisdiction of the South African courts.
